STANDARD TERMS & CONDITIONS

1. VALIDATION
Our quotation is valid for 60 days from issue date unless otherwise agreed.

2. CURRENCY
For contracts within the UK, payment is to be in British Pounds Sterling(£). For contracts within the EU countries, payment is to be in Euros(€)and for all other countries and territories payment is to be in US($) Dollars.

3. PAYMENT
Unless previously agreed, Payment is 30 days from the date of invoice after which time MACC will invoice with additional interest at a rate of 4% above the Bank of England Base Lending Rate, sums quoted are subject to change in line with UK inflation. All MACC Invoices are subject to Value Added Tax (VAT). MACC are not deemed by HMRC to be part of the Construction Industry Scheme (CIS) and are therefore exempt from the domestic reverse VAT charge.

4. INVOICING
Mobilisation will be charged weekly, part thereof, per mobilisation, or as previously agreed. Congestion, toll and parking charges will be invoiced at cost plus 15% and charged retrospectively where applicable.

5. RETENTION
Retention of fees to MACC services invoices are not considered appropriate and retention of fees are not accepted.

6. WORKING HOURS
Unless previously agreed in writing, our minimum booking charge is based on our quoted rate or rates for working 8 hours during normal working hours (08:00-17:00 hrs) Monday to Friday. Overtime worked outside these hours on Monday to Friday is charged at time and a half for pro rata weekday hours, Saturday is charged at time and a half and double time is charged on Sunday or Public Holidays.

7. CHANGING CIRCUMSTANCES
UXO survey, investigation and related services can uncover problems previously unforeseen. Where this occurs, we may require to review contractual or costing agreements before any further work can proceed.

8. DISPOSAL OF EXPLOSIVE ORDNANCE AND SCRAP
Costs may be raised for the disposal of explosive ordnance, ordnance scrap and domestic scrap.

9. UNDERGROUND SERVICES
All buried services must be marked clearly and indicated to MACC in writing before start of work. If these conditions have not been met, MACC cannot be held responsible for any damage sustained to any buried services. The rights and obligations of this condition will not be altered by subsequent electronic or other searches and MACC does not, under any circumstances accept consequential losses as a result of our work.

10. SITE ACCESS
Unless we have been specifically asked to carry out a site visit prior to our quotation, we will assume we have clear access for personnel and machinery to enable us to carry out the work.

11. ADDITIONAL EQUIPMENT
Should it become necessary to provide any specialist equipment or protection such as lighting, traffic control, watching or monitoring of the work, we would require payment at day work rates, as detailed in our estimate and for any additional delivery and hire of equipment at cost plus 15%.

12. INTERRUPTED WORK
We seek continuous and uninterrupted sequence of operations. Where MACC have provided a ‘fixed price sum’ to complete the work, we will require to be fully compensated for all costs and losses incurred by us due to delays or standing time beyond our control.

13. CANCELLATION OR POSTPONEMENT OF WORK, INCLUSIVE OF PROVISIONAL BOOKINGS
MACC require two working days written notice to postpone or cancel planned work. Where this notice is not provided, the client will be charged a cancellation fee equivalent to the full day rate plus an administration fee equivalent to thirty percent of the full day rate.

14. CLIENT CONFIDENTIALITY
MACC control all of its client’s correspondence, reports, data etc, as 'OFFICIAL' and handled in accordance with GDPR. MACC will only pass such material on to the procurer or their nominated person[s], after which they become completely responsible for report confidentiality. No such material relating to the client’s projector business activity will be communicated to a third party without the client’s prior approval. The assignment of reports and other material will be actioned with the written agreement of the client. The assignment of any document is only provided in accordance with the terms, conditions and limitations stated within the assignment document.

15. CLIENT DISCLOSURE
To facilitate the accurate production ofreportsand to comply with ourdue diligence obligations, the client will be required to provide MACC with a full disclosure of all UXO risk related information concerning the site that they may havein their possession, that they may be privy to or are aware of, including anecdotal accounts. They will also be required to provide a ‘Red Line’ boundary drawing of the project and a summary of the scope of intended works including future intentions for the land’s ‘end use’.

16. CONTRACTUAL DISPUTES
If a contractual dispute arises beyond negotiation, English Law will apply and subsequent proceedings will be heard in Ipswich, England.

17. ENVIRONMENTAL CONDITIONS
MACC requires all relevant environmental data to ensure no environmental incidents occur and to adhere to MACC’s ISO 14001-2015 policies.
